Bouchier is comprised primarily of Bouchier Contracting Ltd. and Bouchier Site Services Ltd., with its Head Office based in Fort McKay, Alberta and the Administrative Hub based in Fort McMurray. We are an Aboriginal owned and operated company that currently employs a workforce of more than 800 individuals.

In operation since 1998, we provide a variety of services to the Athabasca Oil Sands Region and have a presence on many of the major Oil Sands Mine Sites. Bouchier is one of the leading First Nations companies within the Regional Municipality of Wood Buffalo that provides construction, maintenance, and general site services.

Job Description

SUMMARY

We are seeking a Director, Commercial to join our journey!  If you are the ideal candidate, you will be seasoned in contract negotiation and demonstrate exemplary project management, negotiation, market research, and marketing and business development skills. You will collaborate with the CFO and Commercial Team to ensure continued success of the Commercial Department. If you have a solid background in Commercial and a strong desire to become a part of a dynamic team, you may be the perfect person to fill this position.

Primary Responsibilities:

  • Effective development and delivery of commercial related aspects of the annual business plan and three (3) year strategic plan.
  • Work with the Executive Management Team to support Business Group commercial issues including securing consistent commercial processes and philosophies, succession planning, staff selection, development and training and dispute management.
  • Leat the commercial and contractual aspects of the businesses to support operations and projects and set strategies with the objective of minimising risks, maximising opportunities and avoiding disputes.
  • Provide professional focus, identity and leadership to the Commercial Function within the Business consistent with Bouchier standards and objectives.
  • Ensure that the Commercial function delivers effective contractual solutions and strategies that balance risk and opportunity in bids and tenders.
  • Lead, key negotiations with prospective customers, partners, contractors and sub-contractors.
  • Ensure a commercial focus is maintained in established and/or developing markets.

To take the lead responsibility in developing, implementing and reviewing effective commercial activity within projects and services, ensuring that:

  • An overview is maintained of Risk Management processes and procedures, including acting as liaison for internal audit activities.
  • Contractual imperatives (duties, obligations, notices etc.) are observed and discharged to protect Bouchier’s position and entitlements under Contract or with Insurances etc.
  • In conjunction with key internal ‘partners’, ensure that business critical and/or complex contractual and insurance issues, including disputes and claims are resolved in order to protect and further the Company’s interests and relationships.
  • A framework of approved practice and process in commercial activity is followed that is consistent with standards, QMS and corporate governance.
  • Other duties as assigned

Qualifications

Education and Experience:

  • Diploma or University Degree in Business / Commercial / Engineering or related discipline and a pre-eminent knowledge of Contract and Construction law, quantity surveying, commercial management with at least 5 years proven commercial management experience in Head Office, Major Projects at sub-group level.
  • A demonstrable track record of commercial success on a variety of Contract types ideally covering traditional, lump sum, Time & Material, Target Cost etc.
  • A knowledge of Boucher’s business model, operating markets and strategy is an asset.
  • Ideally, Chartered level membership of a relevant professional body (e.g. RICS).

Proven capabilities in:

  • The planning, development and performance of people & projects remotely
  • Project Management, Cost/Value Control and performance monitoring
  • Problem solving and trouble shooting
  • Contractual Claims preparation, presentation and advocacy
  • Negotiation and presentation
  • Dispute management and resolution
  • Sound commercial judgement
