Job Description

ProSidian Seeks a Mining Industry Technical Expert / Consultant [541690 Contract Contingent] located in Cape Town South Africa to support an engagement for U.S. Govt. International Technical Assistance Program (ITAP) providing assistance on technical, regulatory, environmental, and financial management for national development on a range of energy and non-energy resources.  Key Areas of Focus: 1) policy, legal, and regulatory reform; 2) technical, operational, and economic analysis; 3) financial mechanisms and market creation; 4) economic mgmt. , transparency and fiscal policy; 5) environmental impacts and social and community issues related to resource development.  ProSidian provides technical assistance and training related to four Capacity Challenges:  1) TECHNICAL understanding of resources and new extractive technologies / techniques 2) FINANCIAL mgmt.  of revenues from the sector 3) LEGAL best practices for international laws and regulations 4) ENVIRONMENTAL protections for people and environment from sector impacts.  Typical country stakeholders include:  Govt.  officials (national, municipal, regional and village levels); Legislators; national, state, and local regulators; communities (inc. vulnerable groups). 

 

Candidates shall work to support requirements as a Mining Industry Technical Expert / Consultant and provide industry technical expertise, experience, training, and support with Energy, Extractives, and Renewable Energy concerns such as financing and development of projects involving the Mining Industry exploration, extraction, processing, transportation, and sale. We strive to develop a deep understanding of our clients’ business Mining Industry goals and operations to develop tailored, efficient and cost-effective compliance strategies and legal solutions.  Candidates will advise and assist businesses and individuals involved in the Mining Industry on an array of legal and business issues that range from day-to-day personnel and operating concerns to complex regulation and litigation matters as well as policies and procedures pertaining to hazardous materials, land preservation, air and water quality, the protection of endangered species, Mining Industry safety and health concerns require Mining Industry leaders to stay vigilant with regard to compliance and violation management.  In addition, the Mining Industry Legislation Attorney / Consultant works to provide Mining Industry clients counsel on matters regarding ownership, operation, and finance of production assets, including acquisition, joint venture and joint production arrangements; international production sharing agreements; tax sensitive partnership agreements; operating agreements (domestic and international); leases; farm-out and farm-in agreements; production sharing financing; and drilling contracts.

  • Help beneficiary stakeholders and clients analyze Mining Industry policy related to leases and related agreements such as pipeline rights-of-way to ensure leases and associated agreements are properly executed by the correct parties and recorded as necessary.
  • Provide Mining Industry policy advice, assistance, training, and support on a full range of Mining Industry legal matters in domestic and international, conventional and unconventional Mining Industry developments, including: acquisitions and divestitures | financings and offerings | public policy | joint operations | exploration and production | intellectual property and litigation | environmental health and safety | field services and construction
  • Provide Mining Industry policy advice, assistance, training, and support on aspects of the Mining Industry, bringing to bear focused experience that allows us to successfully meet cross-disciplinary legal issues in the Mining Industry
  • Provide Mining Industry policy guidance on real estate, land use approvals and siting issues that affect developing and expanding Mining Industry projects.
  • Provide Mining Industry policy technical expertise, experience, training, and support for asset development efforts including acreage swaps, joint ventures, joint operations, acreage acquisition, and leasing
  • Provide Mining Industry policy technical expertise, experience, training, and support for management on regulatory issues for joint ownership, construction, operations, transportation, commercial, and compliance matters
  • Provide Mining Industry policy technical expertise, experience, training, and support for managing negotiations with royalty owners, joint venture parties, and contractors/suppliers on legal matters and providing guidance on exploration, drilling, and development activities
  • Provide Mining Industry policy technical expertise, experience, training, and support for in matters involving environmental and safety regulations
  • Provide Mining Industry policy technical expertise, experience, training, and support for with negotiating and drafting joint operating agreements, drilling contracts, master services agreements, Mining Industry leases, land agreements, surface access agreements, exploration agreements, farm-outs, purchase and sales agreements, confidentiality agreements, and E&P related agreements.
  • Help beneficiary stakeholders involved in several subsectors of the Mining Industry , including: Conventional and unconventional Mining Industry exploration and production, Midstream, Refining and marketing, Field service, Equipment manufacturing, environmental, Regulatory, technical training, and policy concerns
  • Responsibilities to support teams of Mining Industry experts with combined global experience, proprietary approaches and insights to help clients respond to changes in the market and unlock significant value.

Qualifications

Leadership, Communication, Government  financial management, budgeting, financial modeling, reporting, presentations and at least (10) years Management in fields related to Oil, Gas, Extractives with specialty in management and operations, law, geology, policy, valuations, Corporate Finance, M&A, Energy Investments, environmental policy compliance, Energy Development, Energy Infrastructure, Commodities Management, or Natural Resource markets.

The focus of this work shall be in priority regions countries across The Western Hemisphere [Argentina, Brazil, Colombia, Guatemala, Guyana, Mexico, Panama, and Suriname] | Europe And Eurasia [Bulgaria, Estonia, Latvia, Lithuania, Poland, Romania, Turkey, Albania, and Ukraine]  |  In Sub-Saharan Africa [Kenya, Liberia, Madagascar, Mauritania, Namibia, Senegal, Seychelles, Sierra Leone, Somalia, Tanzania, and South Africa]  |  In The Middle East And North Africa [Algeria, Jordan, Morocco, and Tunisia] | and In Asia And The Pacific [India, Indonesia, Mongolia, Vietnam, Burma, Papua New Guinea, Sri Lanka]

The Mining Industry Technical Expert / Consultant shall have Minimum of Ten (10) years of consecutive employment in a position with comparable responsibilities within the past five (5) years, Must be able to use a computer to communicate via email; and Proficient in Microsoft Office Products (Word/Excel/Power point) and related tools and technology required for the position.

  • Validation of "Recognized Degree" from a top-tier school and experience working for a firm recognized in the country of focus
  • Ideal candidates will have a proven track record strategizing and implementing policy advocacy campaigns, demonstrated knowledge of Mining Industry /energy issues, strong communication and relationship management skills, and high degree of comfort with scientific and technical content.
  • Experience in Petroleum Engineering; Mining Industry Operations on Land and Offshore; Site Management; Industry Practices; Safety; Mining Industry Regulations and Compliance; Equipment Selection and Operation; Incident Investigation; Expert Witness; Drilling, Completion, Production, Fracture/Stimulation and Well Workovers; Well Control including Kicks and Blowouts
  • Minimum five years’ experience in the corporate, public, consulting, academic or non-profit sectors, including demonstrated ability to understand Mining Industry operations and emissions management, managing complex projects and working with external partners to achieve program goals.
  • Previous regulatory and policy experience working on Mining Industry issues is strongly preferred.
  • Excellent written and oral communication skills, particularly the ability to translate highly technical/scientific information for non-experts.
  • Ability to work with colleagues and partners of varied backgrounds and experience.
