Job Description

Wish is looking for a dynamic attorney to join our team as Counsel, Litigation & Privacy. This role will report to the Head of US Legal and will be responsible for handling both global litigation and data privacy matters. 

Litigation:  the attorney will handle various stages of the litigation process, including initial case assessment, factual investigation, discovery, third-party subpoenas, briefings, ADR, and supervising and collaborating with outside counsel. Privacy: the attorney will advise business stakeholders on compliance with data privacy laws and data protection strategies. 

The ideal candidate is: highly organized; able to collaborate effectively with other teams and departments; able to plan and execute projects of all sizes and durations; knowledgeable in US and EU privacy law; naturally curious and a regular user of e-commerce apps; an effective researcher able to develop creative solutions to challenging issues; and comfortable pitching in on any legal task or project with a “no task is too big or small” attitude. 

 

What You’ll Do:

  • Privacy 

    • Analyze the products, features, and systems that Wish engineering builds to help protect the privacy of Wish Merchants and Users and ensure compliance with global privacy regulations;

    • Provide legal advice across subject areas including data protection, privacy, consumer protection, and advertising;

    • Collaborate with commercial counsel to draft, review, and negotiate product team contracts and relevant provisions of various other contracts.

  • Litigation 

    • Contribute to a wide range of defensive and affirmative pre-litigation and litigation issues across varied subject matters, both domestically and internationally;

    • Lead and manage litigation or pre-litigation disputes, including overseeing outside counsel;

    • Manage internal processes and tools related to litigation, including existing and new eDiscovery and litigation-management tools;

    • Conduct legal research as needed;

    • Conduct factual investigations, including witness and employee interviews as needed;

    • Draft and manage litigation holds and internal tools relating to the same. Oversee document collections and manage ESI;

    • Draft meet and confer letters and/or pre-litigation correspondence to opposing party and/or counsel;

    • Draft, revise and manage Wish’s Merchant and User Terms of Service domestic and globally. Manage case files and email correspondence.

  • In House Legal Operations 

    • Learn the Wish business, issue-spot potential risks areas as they may arise, and communicate effectively with Legal and non-Legal teams;

    • Work with internal stakeholders to identify risk areas and develop systems and procedures to manage and reduce risk;

    • Educate US-based and global business partners on key commercial, legal, policy, and other considerations, including providing follow-up information to internal stakeholders to ensure timely performance and compliance with legal obligations, including under contract;

    • Support the internal contract approval process and help to deliver continuous improvement of standard form agreements and legal processes.

Qualifications

  • J.D. (or foreign equivalent) with membership in at least one US state bar.
  • 4+ years of legal experience either in-house or with a reputable law firm.
  • Experience advising clients on complex legal issues including privacy, data use and/or related regulatory matters in a variety of jurisdictions.
  • Ability to multi-task and efficiently manage numerous matters under time-sensitive deadlines.
  • Organized, with an attention to detail.
  • The desire to have ownership over complex legal issues and a portfolio of cases/matters.
  • Mature, self-starter who sees matters/cases through to the end.
  • Flexible and adaptable in a fast-paced, innovative and demanding environment.
  • Sound and practical business judgment, intellectual creativity, work ethic, and problem-solving skills.
  • Strong interpersonal and communication skills and a commitment to professionalism.
  • Sense of humor and ability to not take yourself too seriously.

Preferred Skills:

  • In-house experience at a consumer-facing technology company.
  • CIPP (or some other relevant privacy qualification).
  • Prior experience as a judicial clerk.
  • Knowledge of laws and regulations applicable to e-commerce or platforms/marketplaces.
  • Comfortable with Legal Operations-related tools and systems.
  • ESI experience and experience with online review platforms.
  • Project-management experience.
  • Experience with cross-border disputes or international matters.
