Job Description

As a General Liability Claims Adjuster, you will be responsible for daily management of liability claims, documenting the files over the course of litigation, discussing legal strategies, analyzing reserves, assisting with settlement negotiations, and conveying pertinent information to management. The role requires regular collaboration with defense counsel and VP of Risk Management for strategic planning and negotiating damage settlements.

Essential Duties and Responsibilities:

  • Receive, investigate, and successfully resolve claims.
  • Review legal documents and claim files and provide recommendations for the handling of legal represented claims
  • Follow-up on all new cases to communicate with involved parties and resolve.
  • Coordinate with other departments to investigate claims, obtain documentation and oversee successful safety programs to reduce guest related claims.
  • Maintain close contact with plaintiff and defense counsel and demonstrate an ability to reduce claims litigation, improve claims resolution and the defense of guest claims.
  • Prep files for mediations, present with defense counsel and VP of Risk Management.
  • Manage litigated files
  • Write up settlement evaluations for all litigated cases
  • Attend monthly Resort Safety meetings.
  • Work with insurance carriers and agencies.
  • Run ISO reports when applicable
  • Attend hearings, mediations and trials utilizing proprietary defensible Westgate programs
  • Obtain, review and evaluate medical information on the guest to make sure treatment is casually related to the claim.
  • Present files in round table format to obtain settlement authority and Negotiate settlements.
  • Assist in preparation for hearings and or appeals with our defense counsel
  • Identify possible subrogation opportunities, place responsible party on notice, follow-up and document any recoveries.
  • Coordinate scheduling of depositions of parties to the litigation and notify staff of key litigation dates on shared electronic E-Calendar.
  • Coordinate and assist with investigations of questionable claims in the event of a pre-existing condition and/or fraud.
  • Write up settlement evaluations for all litigated cases
    Gather and report on data, industry patterns, and insurance related topics

Qualifications

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily.  Must have thorough understanding of claims handling practices, policy language, exclusions, and ISO forms. Prioritization, organization, effective time management, creativity and self-discipline are needed to successfully perform in this position.  Setting and achieving goals set is essential, along with the ability to work closely with defense counsel, and effectively manage litigation. The requirements listed below are representative of the knowledge, skill, and/or ability required.

Education and/or Experience:

  • High school diploma or GED required.
  • 1-5 years of related experience and/or training, or equivalent combination of education and experience in liability claims handling.
  • Valid Florida adjuster’s license required.
  • Preference given for college degree and completion of AICPCU course work, such as AIC, ARM, CPCU, and industry-specific continuing education.

Physical Demands:

  • Regularly required to sit, stand, talk, and hear.
  • Frequently required to reach, carry, pull, or push with hands and arms.
  • Lifting objects weighing no greater than ten pounds.
  • Specific vision abilities required, including ability to adjust focus.
  • Specific hearing abilities required for communication.

Language Skills:

  • Ability to read and comprehend simple instructions, short correspondence, and memos.
  • Capability to write simple correspondence.
  • Effective presentation of information in one-on-one and small group situations to customers, clients, and other team members.

Mathematical Skills:

  • Proficiency in adding, subtracting, multiplying, and dividing in all units of measure, using whole numbers, fractions, and decimals.
  • Ability to compute rate, ratio, and percent, and to interpret bar graphs.

Reasoning Abilities:

  • Application of common sense understanding to carry out detailed but uninvolved written or oral instructions.
  • Capacity to define problems, collect data, establish facts, and draw valid conclusions.

Work Environment:

  • Work primarily conducted from an office or field office.
  • Characteristics of the work environment include those encountered while performing essential job functions.
