A key member of Rest's Legal leadership group, you will lead the Member Legal team iIn conjunction with the General Counsel. Your role is responsible for legal matters relating to Rest including providing legal advice to Rest Business Units, Board and management regarding Rest’s legal rights and duties; and managing Legal Counsel direct reports.
- Provide legal advice, provide guidance to the business in relation to legal and regulatory obligations relating to:
- Superannuation products and the distribution of those products
- Member communications and interactions
- Financial advice
- General law trustee matters, the SIS Act and Corporations Act as it applies to Rest
- Estate and family law advisory as it applies to the members of Rest
- Marketing materials
- External facing documents Rest’s members may come into contact with, such as the Rest website any press releases or other forms of communications.
- Life insurance as it applies to the members of Rest
- Participate in the due diligence process as a senior legal stakeholder to provide legal review
- Maintain a good working knowledge of regulatory matters and regulatory change relating to Rest.
- Advise on proposed and actual regulatory changes to stakeholders
- Advise on Rest's licences and the activities of representatives of the Trustee
- Work with the Directors, CEO, Executive Legal Team, General Counsel and Rest management to review and rapidly respond to Government (Federal and State), parliamentary and regulatory correspondence or inquiries
- Manage the review and negotiation of legal agreements and documentation
- Ongoing project support as including participation in Project teams, legal review of documentation and communication materials arising out of Projects.
- Preparation and review of relevant Rest policies as required
- Preparation of reports for Board and Board Committees
- Liaising with external legal providers, auditors, fund administration and regulators when required
- Manage the delivery of legal training to Rest Business Units
Qualifications
- Bachelor of Laws or appropriate business/law degree with admission in an appropriate jurisdiction.
- Hold a current Australian state based practising certificate
- Commercially astute with strong analytical and research skills in complex legal/commercial problems
- Proven expertise in legal roles with an emphasis on financial services, in particular superannuation
- Experience in managing a team
- Thorough knowledge of legal obligations as they relate to superannuation funds and superannuation trustees
- Commercial drafting skills with a focus on clarity and plain English
- Experience in managing multiple projects, and prioritising competing deadlines
- Experience in managing litigated claims
- Ability to work in an environment requiring attention to detail and high levels of accuracy
