Please note this role is a 6 month FTC covering parental leave.
Working with the Group Legal Counsel, the role is responsible for managing legal matters relating to Rest including providing legal advice to Rest Business units, Management, Board and Directors to ensure appropriate management of Rest’s legal rights and duties and legal compliance and managing Legal Counsel direct reports.
- Provide advice on regulatory legal matters and guidance to the business in relation to legislative, regulatory and licensing obligations
- Participate in the due diligence process as a legal stakeholder to provide review and legal advice on required documents and processes
- Advise management on regulatory matters that affect business decisions and the execution of Rest’s strategic objectives,
- Maintain a good working knowledge of regulatory matters and regulatory change relating to the Trustee and Fund.
- Advise on proposed and actual regulatory changes to stakeholders to manage legal risks.
- Advise on Rest’s governance framework including licences and the activities of representatives of the Trustee to properly discharge licence responsibilities.
- Advise on Rest’s regulatory reporting frameworks
- Manage legal aspects of regulatory investigations.
- Assist with liaison with regulators including ASIC and APRA for all communications including meetings and correspondence, preparation of reports, schedules and presentations for APRA prudential reviews, where required. Participate in industry forums and groups to provide input and discussions on regulatory changes and communicate outcomes to relevant internal stakeholders as required.
- Support and advise management on regulatory matters that affect business decisions and the execution of Rest’s objectives
- Assist as required in the delivery of legal training to Rest Business Units.
- Manage litigated matters and disputes where required, including liaison with Rest’s external legal panel and Senior Counsel in relation to litigated matters
- Liaising with external legal providers, auditors, fund administration and regulators when required
- Preparation and review of relevant Fund policies as required
Qualifications
- Bachelor of Laws or appropriate business/law degree with admission in an appropriate jurisdiction.
- Hold a current NSW (or alternate Australian State) practising certificate
Required experience, understanding or credentials including:
- Demonstrate significant experience in legal roles with an emphasis on financial services
- Knowledge of legal obligations of superannuation funds and superannuation trustees
- Experience in advising on incident management and breach reporting
- Strong commercial drafting skills with a focus on clarity and plain English
- Demonstrated ‘commercial’ approach to legal risk management
- Must be commercially astute and possess strong analytical and research skills
- Experience in managing multiple projects, and prioritising competing deadlines
- Ability to work in an environment requiring attention to detail and high levels of accuracy
- Ability to work autonomously where required, meet deadlines and handle constant enquiries from inside and outside the Fund
- Ability to work with all levels of the Fund, well developed interpersonal skills and ability to liaise across the fund and its strategic partners as required will be well regarded
