BUSINESS AFFAIRS – RIGHTS (Talent) MANAGER

The Rights Manager’s role is to work collaboratively, as a partner with Producers, Production Business Managers, and Account teams to ensure that all talent and third-party rights for Commercial, Content, Print and Creative assets are secured, licensed, and compensated in accordance with Legal, Industry Guidelines and Union Agreements. Candidate should also be versed on legal issues within the marketing & advertising space (intellectual property, third party rights, privacy and publicity laws, copyright, and trademark laws) and an awareness of content management and contracts/licensing with the ability to assist in negotiations of talent, music rights, name & likeness and all various other contracts for broadcast, OLV, print, social media and digital platforms. Well versed in SAG-AFTRA/AFM/ACTRA talent unions, off-shore-talent bids, celebrity contracts (possible negotiations) and music licensing for commercials.

The Rights Manager’s role also includes working with numerous agency departments including Creative, Legal, and Finance to assist, consult, educate, inform, and provide guidance which enables the Agency to execute the highest quality creative work. 

This position reports into the Director of Production Operations / Business Affairs.

Key Responsibilities:

  • Manage and consult on all things related to hiring and tracking rights associated with talent and third party rights, including the management of residual budgets for production assets.
  • Be an integral part of the Production Team, reliably available to Producers, Production Managers Business Leadership Teams.
  • Align as an integral part of the production process to review commercial concepts and recommend best method to hire performers and advise/consult on the most cost-effective way to produce/execute a creative asset.
  • Help determine the third-party rights needed and flag any issues. 
  • Be organized and able to actively manage talent budgets and consults with agency producers on estimates & monitor talent and production budgets for TV, Radio, and interactive/integrated/digital production jobs.
  • Be familiar with SAG/AFTRA commercials contract, union waivers to reduce client costs, i.e., Low Budget Waivers, Internet Only, etc.). Procure SAG/AFTRA waivers (i.e. Low-Budget, PSA, Experiential Coverage, Experiential Social Media). Prepare performer contracts/releases. Review all executed contracts, licenses, and process session payments.
  • Be familiar with union, federal, and state work requirements and restrictions, especially as it relates to hiring minors in production
  • Review contracts, screen finished commercials to develop final cast reports, facilitate/manage talent payments, and renegotiate talent contracts. 
  • Ability to manage, negotiate, and track rights associated with stock images, footage, and any other third party rights utilized in production assets.
