Job Description
The position
The Publishing Intellectual Property Counsel will be responsible for providing legal guidance and support for intellectual property matters related to video game development, publishing, and distribution.
As the Publishing IP Counsel you will be responsible for providing practical, business oriented and comprehensive advice and research to assist our Irish self-publishing operations, our Polish based Warsaw Stock Exchange listed company as well as all other Group companies on a range of legal and business intellectual property related matters, with a strong emphasis on self-publishing, development under the work-for-hire model advice, as well as copyright advice, marketing advice, and software compliance advice. You will also liaise with our external legal counsels in foreign jurisdictions such as Poland, US, UK, Canada and Ireland.
You will work directly with the CEO, General Counsel and the People Can Fly Legal Team located in Warsaw, Poland.
You should bring a high level of a business view, initiative and a strong work ethic. We are looking for a person with the ability to work across-borders with various teams across the organization with a solid and comprehensive experience in in-house video game counseling.
Duties and responsibilities
- Provide legal guidance on intellectual property matters related to video game development, publishing, and distribution, including trademark, copyright, trade secrets, and licensing agreements
- Draft, review, and negotiate publishing and development agreements, licensing agreements, content acquisition agreements, distribution contracts with first parties and other intellectual property-related contracts
- Draft, review and negotiate a range of complex technology transaction and other IP related commercial terms and agreements
- Assist CEO and the General Counsel in negotiations of the same
- Support the continuous improvement of standard form agreements and legal processes in People Can Fly Group
- Conduct legal research and analysis on intellectual property issues and provide recommendations on strategies for protecting the Group’s intellectual property assets
- Work closely with game development teams to identify and address potential intellectual property issues during the game development process; assist development teams with copyright clearances
- Manage and enforce the Group’s intellectual property rights, including monitoring for potential infringement and taking appropriate legal action when necessary
- Collaborate with external counsel as needed to manage and resolve complex intellectual property matters
- Provide training and guidance to internal teams on intellectual property-related matters to ensure compliance with relevant laws and regulations
- Stay up-to-date on changes in intellectual property law and industry trends to inform strategic decision-making
- Other projects and duties as assigned
Qualifications
- Have a minimum of eight (8) years of relevant professional experience, preferably as an in-house video game industry counsel, with proven administrative skills
- Proven competence in IP, including video game and technology, legal and business environment with practical knowledge of the operations of large video game organization operating in a multi-jurisdictional environment
- Experience drafting and negotiating complex intellectual property-related contracts
- Knowledge of consumer and digital services laws will be an added advantage
- Strong knowledge of trademark, copyright, trade secrets, and licensing law in various jurisdictions worldwide, including copyright and trademark registrations and prosecution as well as management of copyright and trademark portfolio
- Knowledge on music licensing process
- Solid experience in applying knowledge of legal analysis and principles to deliver full scope of strategic legal advisory services in line with People Can Fly’s strategy, needs/situation
- Ability to work independently and manage multiple task assignments as well as part of a multicultural team
- Working experience at the management levels
- Experience in managing complex projects
- Ability to drive change and to be flexible, open minded with integrity
- Excellent communication and interpersonal skills, with the ability to communicate complex legal concepts to non-legal stakeholders
- Strong analytical and problem-solving skills, with the ability to identify and address potential legal issues proactively
