Job Description

The Employment Counsel is a trusted advisor to the business, providing pragmatic legal advice, judgment and assistance on all employment and labour matters. Demonstrating a strong foundation in applicable legislation and human resources requirements, practices and policies, the Employment Counsel is focused on assisting Indigo in achieving its priorities, projects and processes, while mitigating risk and liability in a cost-effective manner.

WHAT YOU’LL DO: 

  • Proactively identify arising risks and work with the business to develop preventative or mitigation solutions
  • Support Indigo goals by executing on short to mid-term departmental goals
  • Maintain a high level of strategic foresight by identifying customer and business needs, and adjusting departmental and team objectives accordingly
  • Provide proactive, pragmatic legal advice and support directly to business units on a wide range of labour and employment law issues
  • Manage employment and customer human rights civil and administrative claims and proceedings, including provision of preliminary advice, drafting of initial correspondence, and coordination and oversight of local counsel, as needed
  • Conduct and/or assist Human Resources internal investigations
  • Manage and support collective bargaining process as well as implementation of collective agreements and grievance and arbitrations
  • Draft, customize and update legal documents (e.g., employment, severance, and settlement agreements, employee handbooks and policies, and regulatory disclosures)
  • Support Human Resources in developing and conducting training and education programs for leaders and employees, including targeted efforts and ongoing preventative training
  • As an in-house generalist, from time to time, review, draft, interpret, negotiate and advise stakeholders on commercial contracts related to staffing and compensation matters, including, but not limited to, staffing agreements, consulting agreements, service agreements, and scopes of work
  • Seek out, manage and refine new, cost-effective legal service delivery approaches and technology
  • Provide support and assistance to SVP, General Counsel & Corporate Secretary and Legal Department at all levels and in all other areas, as required
  • Ensure the execution of team deliverables and adapt team priorities based on changing needs
  • Set/adhere to team budgets, as applicable
  • Act as an advocate for the customer by placing them at the forefront of all design and decision-making processes
  • Embrace and seek out technology that creates high tech and high touch solutions for Indigo’s customers
  • Proactively identify and anticipate customer expectations and needs
  • Challenge the status quo by consistently identifying areas for improvement, diagnosing issues and working to resolve them
  • Develop strong, collaborative cross-functional relationships that support key business partners
  • Develop position of employment law function as a strategic adviser, building engagement with HR leadership team and business partners
  • Supports the creation and maintenance of a talent succession plan
  • Collaborate with others to drive flexible and iterative solutions, quickly and easily
  • Share technical knowledge with others and actively seek to learn from those more knowledgeable than yourself
  • Help others see the impacts of their efforts and proactively engage other functions to get input

Qualifications

WHO YOU ARE: 

  • Called to the Bar of Ontario with membership in good standing with the Law Society of Ontario, or similar designation in another Canadian province
  • Law degree
  • 3+ years of legal experience in Employment Law in Canadian private practice or in-house
  • Proven negotiation and dispute resolution skills
  • Maturity of judgment and discretion; a belief in accountability and ownership
  • Technical competence in employment and labour law, including strong knowledge of applicable provincial and federal legislation such as provincial employment standards statutes, labour relations statutes and occupational health and safety regimes.
  • Ability to simplify legal concepts for non-legal audience
  • Ability and willingness to make pragmatic decisions with a creative and innovative approach to problem solving
  • Ability to build relationships with business units and stakeholders and influence decision-making at the operational level
  • Ability to work independently, and with teams that have diverse skills, knowledge and educational backgrounds
  • Excellent written and verbal business communication skills
  • Excellent time management skills and demonstrated ability to prioritize, meet conflicting demands and deal with time-sensitive issues
  • Passion for the Indigo brand
  • Minimal travel required 
  • Working knowledge of French is an asset
