Job Description

It is an exciting, yet critical time for our teams at Equinox Media and we're looking for a highly motivated attorney to help shape our product and privacy practice as our teams bring new ways of connecting people to the communities and fitness that they love every day. You are our ideal teammate if you have 6 to 8 years of proven privacy/data protection & security, product counseling, IP portfolio management, and related commercial contracts experience gained at a leading law firm and in-house at a technology or Internet (ideally consumer-facing business or eCommerce) company to join its rapidly growing legal team. In this position, you will lead the legal team’s efforts in the foregoing areas and work closely with our business to manage and execute on a broad range of initiatives applicable to our platform. Our team embraces a true entrepreneurial spirit; operating with humility, collaboration, perseverance and care for one another. This position reports directly to the General Counsel and is based in the company’s headquarters in New York City.

This position’s principal responsibilities and duties include:

Privacy & Security

  • Developing, scaling and overseeing our Privacy Program, including privacy operations and documentation, employee training, policy enforcement, monitoring and auditing, and incident response
  • Working closely with our product and engineering teams to advise on privacy-by-design during the development of new business lines, products, and features
  • Leading efforts to scope and perform periodic data privacy risk assessments, mitigation, and remediation, including data control design and monitoring, as well as the mitigation of privacy and security risks
  • Remaining on top of relevant domestic and international consumer protection, privacy and data handling/protection/security laws and regulations, as well as on technological developments and industry standards in order to provide forward-thinking legal counsel and strategic solutions that enable the business to compliantly achieve business objectives in an evolving regulatory landscape

Product

  • Leading all legal matters related to the development and release lifecycle of our platform, including review of web and in-app interfaces and other related features and initiatives
  • Advising business teams on user experience, product flows, and other product-related matters to ensure compliance with consumer protection, privacy, payment, marketing, and other applicable laws and regulations
  • Drafting and maintaining terms of use, privacy policies, disclosures, disclaimers, FAQs and related communications, and implementing appropriate processes applicable to the foregoing
  • Intellectual Property & Patents
  • Furthering the development of our IP portfolio, including conducting strategic IP due diligence, patent preparation and prosecution, portfolio development and management, freedom-to-operate, infringement and validity analyses, and risk evaluation and mitigation strategies 
  • Scaling our global trademark portfolio, including conducting trademark clearances, filing trademark applications and advising on infringement risks
  • Monitoring and enforcing against IP infringement activities by third parties

General

  • Drafting and negotiating commercial agreements and supporting the legal team’s efforts in contract negotiations as it relates to applicable privacy, data security and IP provisions and review of vendor security assessments and DPAs
  • Leading or assisting the legal team’s efforts in the preparation, implementation, and refinement of appropriate forms, processes, and procedures
  • Building close relationships with the business and maintaining a deep connection with the product, the underlying technology, and evolving industry standards
  • Managing outside counsel in your areas of coverage
  • Conducting periodic employee training on relevant matter
  • Engaging in or leading various other legal projects and duties as needed, including due diligence and related support on strategic transactions

Qualifications

  • J.D. from a top law school with exceptional academic credentials 
  • 6-8 years of relevant experience, including at least 3 years at a leading law firm and significant time spent in-house in roles of increasing responsibility
  • Deep working knowledge of domestic and international privacy and data protection laws, including CCPA, Privacy Shield, GDPR and HIPAA; CIPP/US or CIPM certification strongly preferred
  • Must be admitted, active and in good standing with the New York State bar
  • Experience interacting directly with law enforcement personnel or privacy and data protection regulators a plus
