Job Description

As a Junior Legal Counsel specialized in Data Protection, you will contribute and ensure the Company’s (and all companies/subsidiaries in its group) compliance of data protection, e-privacy and related laws and regulations, reporting to the Head of Legal and in constant collaboration and coordination with the DPO and Management of the Company (including the Board of Directors of Byborg Enterprises SA if needed).  

Position to be based in Luxembourg or in Budapest.

Main tasks and responsibilities:

  • To support and advise in connection with GDPR compliance processes, including ROPAs, DSR requests, DPIAs, etc. and follow up and maintain documentation.
  • To assist in the drafting, review and maintenance of company policies and procedures for data protection and privacy-related matters.
  • To review and draft Data Processing Agreements, Standard Contractual Clauses and keeping other legal and regulatory requirements.
  • To support relevant departments in the company and its subsidiaries related to data protection operations.
  • To assist in the modification, update and maintenance of privacy contracts, privacy policies;
  • Follow up with changes in law and issue recommendations to ensure compliance in full accordance with the guidelines of the DPO;
  • Provide guidance to customer’s support community;
  • Assist with updating business privacy policies and any other privacy documents reflecting personal data processing activities;
  • Advise and assist various internal stakeholders and/or departments in development and maintenance of standard contract terms and conditions in line with data protection provisions and address legal or administrative related queries in a proactive manner;
  • Advise on risks and liabilities of proposed commercial transactions and devise creative and practical legal solutions to meet business objectives;
  • Help to develop and manage internal controls relating to privacy legal frameworks;
  • Research and respond to day-to-day privacy-related questions from internal business clients as these arise;
  • Ensure that business is advised of changes to data protection/privacy related law/regulations and work closely with business to implement any operational changes;
  • Provide legal guidance that balances applicable privacy and data protection requirements with practical, commercial considerations for the relevant stakeholders;
  • To support and advise in connection with GDPR audits.
  • Work closely with the Data Protection Officer to ensure Company’s compliance and implementation of all the processes and systems as indicated by the DPO.
  • In alignment with DPO, make sure that data protection/privacy related incidents, breaches, and risk events are appropriately reported, recorded and in line with company policies and applicable regulations;
  • Work together with other members of legal team in the group and ensure prompt support in data protection field in a pragmatic and solutions oriented manner.
  • Fulfil responsibilities aligned to the Data Protection Strategy and Governance Framework of the company and its group.

Qualifications

  • EU Law degree from a recognized institution.
  • Master’s degree in the IT/IP/DP field.
  • Professional qualification (as a registered attorney) is not essential if proven professional experience in the data protection field.
  • Data Protection certification (e.g. CIPP/E) would be preferred.
  • Relevant professional experience (1-3 years) in the field of data protection (either in-house, law firm or both).
  • Legal proficiency in Data Protection as well as sound knowledge of ICT/IT terminology and environment.
  • Prior experience in preparing and maintaining ROPAs, DPIAs and DSR registries and procedures would be a strong advantage.
  • Excellent drafting skills as regards Data Protection related documents and contracts
  • Communication skills (simplify legal language) with specialists and non-specialist recipients across departments (numerous interactions with product owners, project manager, ICT/IT specialists). 
  • Full proficiency of the English language and legal terminology. French would be an asset.
  • Hands on and pragmatic approach aimed at providing compliant solutions for the business
