About the Worker Protection Team

The mission of the newly-established Worker Protection Team is to protect the rights of workers in San Francisco and California with an emphasis on combatting systemic business practices that exploit marginalized workers.  Building on the Office’s longstanding leadership in affirmative litigation, the Worker Protection Team investigates and litigates instances of wage theft, employee misclassification, and other abusive workplace practices.  The Worker Protection Team also advises and supports the City’s Office of Labor Standards Enforcement, which enforces more than two dozen local workplace protection ordinances, including ordinances that establish rights to a minimum wage, paid sick leave, paid parental leave, and healthcare benefits.

This is the first deputy position on the Team and the candidate will work in collaboration with a Team Leader, support staff, and other attorneys in the Office.

Deputy City Attorney Position and Responsibilities

Attorneys on the Worker Protection Team pursue affirmative investigations and civil litigation, and represent the Office of Labor Standards Enforcement in administrative matters.  They handle all aspects of their investigations and cases, including case assessment, litigation strategy, client communication and coordination, conducting and responding to discovery, all motion practice, settlement evaluation and negotiation, trial, and appeal.  Attorneys will develop novel legal strategies to combat exploitative employment practices and work directly with witnesses and workers on sensitive matters.  Attorneys will also assist in advising and supporting the City’s Office of Labor Standards Enforcement with contracting, promulgating regulations, and other matters.  To ensure broad outreach to identify illegal practices and develop new cases, attorneys are expected to represent the Office in public forums and work collaboratively with other public agencies and community organizations.

Qualifications

Minimum Qualifications

  • Licensed to practice law in California.

  • Demonstrated commitment to litigating or advocating on behalf of workers or other marginalized groups.
  • Excellent oral and written communication and advocacy skills.

  • Ability to exercise good judgment, multi-task, and meet deadlines.
  • Strong interpersonal skills and a positive attitude.

  • Three or ideally more years of civil litigation experience, preferably in labor or employment law on behalf of workers or building affirmative cases.
  • Additional language skills are a plus.

Salary and Benefits
