Job Description

BlueScope’s ethics and compliance function coordinates and formalizes the company’s approach to compliance.  The Ethics & Compliance Manager – North America (ECM) helps oversee ethics and compliance in the region.  The ECM has matrix reporting lines and also reports into the corporate Ethics and Compliance function.

The ECM provides subject matter expertise to support the development of the company’s Global Ethics and Compliance Program, which includes supporting and coordinating strong compliance across the North American businesses to reduce risk of non-compliance.

The ECM works collaboratively with stakeholders to cultivate a strong corporate culture and ensure the North American businesses, as well as its employees and business partners, are aware of, and acting in compliance with, all regulatory and ethical requirements applicable to the company’s business.  The ECM plans, designs, implements, and maintains all regional compliance policies, procedures, and programs in a way that promotes a culture of compliance.  In addition, the ECM plays a leading role on compliance investigations and provides general compliance advice to various corporate functions.

Primary Duties & Responsibilities

  • Primary responsibility for stewarding the ethics and compliance program in North America, including certain core risk areas such as third party due diligence/supply chain sustainability, antitrust, records management, anti-bribery & corruption, conflicts of interest, privacy and sanctions (Core Areas) as well as certain other areas (Supporting Areas) where other functions have primary responsibility (e.g., OSHA, Buy American, Human Rights, Privacy, Environmental).
  • Works as part of the global compliance function and engages with the corporate Ethics and Compliance function.  In consultation with the Corporate Ethics and Compliance Manager, amends local policies and procedures (including training) as necessary in light of the trends identified through reports and investigations.
  • Designs and delivers training and ensures appropriate communications are delivered to employees and third parties, and also leads any compliance investigations.
  • Conducts risk assessments for the Core Areas and assists with risk assessments for Supporting Areas (in conjunction with Risk and Internal Audit, as appropriate).  Ensures contracts contain relevant compliance controls.  Provides horizon scanning for emerging risks and regulatory developments in North America.
  • Conducts third party due diligence, including supply chains of key suppliers.
  • Provide assistance with obtaining Engineering Licenses and general due diligence (monitoring, responding to inquiries, etc.).

Qualifications

Minimum Education & Experience Qualifications

  • Juris Doctorate degree
  • 3 years of experience in Ethics & Compliance with demonstrated experience within a corporate compliance, risk, audit or legal department or advising on Ethics & Compliance

Preferred Education & Experience Qualifications

  • 5+ years of experience in Ethics & Compliance with demonstrated experience within a corporate compliance, risk, audit or legal department or advising on Ethics & Compliance
  • Certification in ethics and compliance (e.g. CCEP); anti-bribery/anti-corruption (e.g. TASA); or privacy (e.g. CIPP)

Technical Skills & Competencies

  • Familiarity with FCPA, UK Bribery Act, and other international anti-bribery and anti-corruption laws
  • Familiarity with the guidelines issued by the Department of Justice and Office of Foreign Assets Control regarding compliance programs
