Job Description
The Legal Counsel will be part of AbbVie China Legal team and will report to the Regional Counsel for Japan, Mainland China and Taiwan. The Legal Counsel will have responsibilities for providing legal supports to AbbVie business and operation in mainland China as assigned by the Regional Counsel.
Major Responsibilities:
- Serve as strategic and legal lead counsel for a pharmaceutical business unit and several internal departments, for example Business Development, Public Affairs, Procurement etc..
- Provide clear advice to business clients on laws and regulations focusing on areas of promotion, patient support, market access, go-to-market strategies and innovative collaboration models.
- Work with business clients to identify and anticipate risks and opportunities and devise appropriate business-oriented solutions to maximize market access and brand strategies.
- Draft, review and negotiate a wide range of agreements such as complex commercial agreements, service agreements, distribution agreements, BD agreements, collaboration agreements and other corporate agreements.
- Support business development projects and other strategic projects under the supervision of Regional Counsel.
- Handle corporate secretarial work and manage disputes and litigations.
- Identify complex to highly complex legal issues related to assigned significant strategic matters; propose solutions and align on business and legal high risk matters with maturity to challenge, enable, or escalate as needed.
- Support matters delegated by the Regional Counsel and work with other US-based or international lawyers within AbbVie on specific matters or projects.
- Adopt a problem-solving approach and appropriate risk perspective to find legal solutions to a wide range of matters. Advise and resolve standard and complex legal matters in practice area independently.
- Resolve legal issues using negotiation skills and legal expertise. Execute core job responsibilities in a timely manner.
- Help select and direct the work of outside counsel, define and manage project objectives and budget.
- Collaborate cross-functionally, both at local and global level, and find solutions for business clients consistent with the law, policies/procedures, and AbbVie’s Code of Conduct.
- Closely monitor the legislative and enforcement development affecting life science industry, raise legal awareness within the organization.
Qualifications
Education / Experience required:
- Must have a law degree from a reputable Chinese university, overseas education background is a plus.
- Bar admission (China, US or other major jurisdictions)
- At least 5 - 8 years prior working experience, preferably gained from a reputable law firm or as an in-house counsel in an international organization. In-house legal experience with a multinational company in the life science industry is a plus.
- Expertise in various aspects of drug development and local regulations, including pharmaceutical regulation, antitrust and competition law, general corporate and anti-bribery law, privacy and compliance.
- Good understanding and experience with intellectual property protection or business development transactions in pharmaceutical industry is a plus.
